Pelan Terms of Service (Public Offer) and Privacy Policy

Part I. Terms of Service (Public Offer)
About the nature of the service
The service is provided exclusively remotely by an operator who is located and carries out its activities outside the country of the user’s residence and/or citizenship. The operator has no office, employees, representatives, agents, server infrastructure, or any other commercial or physical presence in the user’s country. Using the service from any country does not create a presence of the operator in that country, does not mean the operator conducts business in its territory, and does not create any permanent establishment of the operator. The user is solely responsible for ensuring that their access to and use of the service comply with the laws and requirements of the jurisdiction of their residence and/or citizenship.
1. General provisions
1.1. This document is a public offer (the “Terms”, the “Agreement”) of the Operator of the Pelan service (the “Operator”, “we”) to provide access to the Pelan service. The offer is addressed to any legally capable individual (the “User”, “you”) who starts using the service.
1.2. Key terms:
- Service / Bot / “Pelan” — the Pelan software service, available in the Telegram messenger under the name @indo_pelan_bot, which uses artificial-intelligence technologies to help the User compose replies and build a communication strategy in cross-cultural communication.
- AI assistant — the Bot’s functionality based on artificial-intelligence models of third-party providers.
- Request — a single message from the User to the Bot (text, an image/screenshot, a voice message, or a combination of these) to which the Bot produces one reply. One Request uses one Credit (for paid Requests).
- Credits — units of access to paid Requests, purchased as one-time packages.
- Plan — the terms of access to the Bot (the free limit, Credit packages).
- Telegram — the messenger through which the Service is provided. Telegram is an independent third party; the Operator does not control its operation.
1.3. By using the Bot, you confirm that you are at least 18 years old, have full legal capacity, and are entitled to accept these Terms. If that is not the case — please do not use the Bot.
2. Subject of the Terms and acceptance
2.1. The subject of these Terms is providing the User with access to the Pelan Bot under this Agreement: free of charge within the daily limit and/or on a paid basis under the selected Plan.
2.2. Acceptance of the Terms. Any of the following actions constitutes full and unconditional acceptance of these Terms: starting the Bot (the /start command), sending your first Request to the Bot, or paying for any Plan. By taking any of these actions, you confirm that you have read and accepted these Terms and the Privacy Policy (Part II). Acceptance of the Terms (the contractual conditions) and consent to the processing of personal data are separate matters: data processing is governed by the Privacy Policy (Part II), and you give your consent to the processing of the content of your Requests knowingly, by sending it to the Bot — and you may withhold that consent by not sending such data.
2.3. If you do not agree with the Terms — do not use the Bot and do not pay for any Plans.
2.4. The current version of the Terms is always available via the /terms command in the Bot and via the link on the service’s page. We recommend saving it or re-reading it from time to time.
3. Service description and important disclaimers
3.1. What the Bot does. The User describes a communication situation to the Bot (sends text, a screenshot of a conversation, or a voice message). The Bot returns: a ready-to-send reply option, an explanation of the context, and recommendations on the dialogue strategy in cross-cultural communication.
3.2. This is communication assistance — not translation and not professional advice. The Bot helps you compose messages and understand cultural context. The Bot is not a translator in the strict sense and does not provide legal, financial, tax, immigration, visa, medical, or any other professional services or advice.
3.3. Recommendations only. All of the Bot’s replies are informational and advisory in nature. The final decision on what to say, how to say it, and what actions to take is always made by the User, who bears responsibility for it.
3.4. No guarantees of outcomes or third-party behaviour. We do not guarantee that using the Bot will lead to the desired outcome of your negotiations, to agreement, or to any particular behaviour of the people you communicate with. The behaviour of third parties is beyond our control.
3.5. AI can make mistakes. Replies are generated by artificial-intelligence models and may contain inaccuracies, factual errors, or wording that is incomplete or inappropriate for a specific situation. Before relying on a reply in important or sensitive situations (contracts, money, dealings with government authorities, health, safety), always verify the information and, where necessary, consult a relevant professional.
3.6. Service availability. We aim to keep the Bot running reliably, but we provide it “as is” and “as available”. Interruptions, failures, limitations, and changes in functionality are possible, including those related to the operation of Telegram and third-party AI providers. We do not guarantee uninterrupted or error-free operation.
3.7. Dependence on third parties. The Bot runs on Telegram’s infrastructure and uses third-party AI providers (see Section 4 of Part II). Failures, rule changes, or discontinuation of those services may affect the Bot’s availability and quality, and this is beyond our control.
4. Plans: free access and Credit packages
4.1. Free access. The User may send up to 3 Requests per day free of charge. Free access is provided at the Operator’s discretion: its scope (including the daily limit) may be changed, and free access itself may be limited, suspended, or discontinued at any time without prior notice. The provisions on advance notice and refunds (clauses 5.6, 8.1, 8.3) apply to paid Plans.
4.2. Credit packages (one-time purchase). Packages of 10, 30, 100, and 300 Requests are available. One Credit is used per Request. Once the free daily limit is exhausted, Requests are deducted from your available Credits.
4.3. Credit validity. Credits are valid for 2 months from the date of purchase of the respective package. After this period, unused Credits expire and are not restored — to the extent this does not conflict with mandatory provisions of the law applicable to you (see clause 4.5).
4.4. Credits are non-refundable and non-transferable. As a general rule, Credits are non-refundable, cannot be transferred to other users, and cannot be exchanged for money. This rule applies to the extent it does not conflict with mandatory provisions of the law applicable to you (see clause 4.5).
4.5. Mandatory provisions. The provisions on non-refundability and validity periods apply subject to your inalienable rights under the law applicable to you. If a mandatory legal provision gives you more rights than these Terms, the legal provision prevails.
5. Payment
5.1. Payment methods. Plans are paid for via Telegram Stars and via the Tribute service (bank card / SBP (Russian fast payments system) / Telegram Stars). The available methods and prices are shown in the Bot’s interface at the time of purchase.
5.2. Prices. Current prices are shown in the Bot. The price may depend on the payment method. We may change prices going forward; a change does not affect purchases already made.
5.3. One-time payments, no auto-renewal. All purchases (Credit packages) are one-time. This is not a subscription: there is no automatic renewal and no automatic charging. Once your Credits are used up or expire, access to paid features stops until your next voluntary purchase.
5.4. Moment of performance. The service is considered provided (access granted) from the moment the Credits are added or the Plan is activated in the Bot.
5.5. Payment intermediaries. Payments are accepted and processed by third-party services (Telegram, Tribute, payment providers). Their operation is governed by their own rules; we do not store full payment details (such as card numbers) and do not control the operation of payment systems.
5.6. Refunds. As a general rule, completed purchases are non-refundable, except in cases expressly provided for by the law applicable to you and in cases where the service was not properly provided through our fault (for example, a technical failure due to which Credits were not added or cannot be used, or substantial unavailability of the service). In these cases, upon your request, we will refund the payment for the unprovided (unused) part or restore the corresponding Credits. Send refund requests to the contact in Section 10.
6. Acceptable and prohibited use
6.1. You agree to use the Bot in good faith, for personal purposes, and in accordance with the law applicable to you.
6.2. It is prohibited, in particular, to:
- use the Bot for any unlawful purposes, including deception, fraud, threats, harassment, blackmail, incitement of hatred, or discrimination;
- automate access to the Bot (bots, scripts, scrapers, emulators), organize bulk or load-generating requests, or circumvent limits and anti-abuse measures (including via multiple accounts);
- resell access to the Bot, provide it to third parties, or use it as a front for providing services to an unlimited number of people without our consent;
- upload malicious code, attempt to disrupt the operation, security, or integrity of the Bot and related infrastructure, or gain unauthorized access;
- enter personal data of third parties without a lawful basis (see also Part II, Section 7), or other people’s confidential data you have no rights to;
- use the Bot to create content that infringes the rights of third parties (including intellectual property rights) or to generate content prohibited by law.
6.3. Consequences of violations. If you violate this section, we may, without prior notice, restrict or terminate your access to the Bot, including without refunding amounts paid to the extent related to the violation (within the limits allowed by the law applicable to you).
7. Limitation of liability
7.1. The Bot is provided “as is”. To the maximum extent permitted by the law applicable to you, and subject to clause 7.3, we are not liable for factors beyond our reasonable control or for the consequences of your own decisions, in particular for:
- decisions you made and actions you took relying on the Bot’s advisory replies (see clause 3.3);
- the behaviour, actions, or omissions of third parties (interlocutors, contractors, organizations, authorities, and others);
- lost profits or indirect, incidental, or punitive damages;
- interruptions, failures, or unavailability of the Bot, as well as failures of Telegram, payment systems, and third-party AI providers.
This does not release the Operator from liability for its own violations or for inadequate quality of the service itself, to the extent such a release is not permitted by mandatory provisions of the law applicable to you (see clause 7.3).
7.2. Liability cap. To the extent permitted by mandatory provisions of the law applicable to you, if the Operator is held liable, its aggregate liability is limited to the amount you actually paid for using the Bot during the 3 months preceding the event. If such a limitation is not permitted by law, the legal provision applies.
7.3. Inalienable rights. Nothing in this section limits or excludes the Operator’s liability to the extent this is prohibited by mandatory provisions of the law applicable to you — including liability for inadequate quality of the service itself, for intent or gross negligence, and for harm to life or health.
7.4. Your representations and indemnity. You are responsible for the lawfulness of the data you provide to the Bot and for respecting the rights of third parties. If third parties bring claims against us because you violated these Terms, you agree to compensate our reasonable, documented expenses within the limits allowed by the law applicable to you.
8. Changes to the Terms and termination of access
8.1. Changes to the Terms and Plans. We may change the Terms, the feature set, Plans, and prices. A new version takes effect upon publication (via the /terms command and via the link on the service’s page) unless a later date is specified in it. Changes are not retroactive and do not affect purchases already paid for. We give advance notice of material changes that worsen your position; such changes may require your renewed explicit consent, and if you disagree, you may stop using the Bot. Continuing to use the Bot after non-material changes take effect constitutes your acceptance of them.
8.2. Termination by the User. You may stop using the Bot at any time, including by blocking it in Telegram. This does not create an obligation to refund payments, except in the cases described in clause 5.6.
8.3. Termination by the Operator. We may suspend or terminate your access: if you violate the Terms (Section 6); if there are signs of abuse or a security threat; if required by law or by the rules of Telegram / payment systems; or if the service is discontinued. Where possible, we will notify you in advance, unless this conflicts with the law or harms security.
8.4. Service shutdown. If we shut down the Bot entirely, we will try to announce it in advance.
9. Dispute resolution
9.1. The parties will try to resolve disputes through negotiations. Complaints should be sent to the contact in Section 10; we will try to respond to a complaint within a reasonable time.
9.2. These Terms are governed by the law determined under the applicable conflict-of-laws rules. If you are a consumer, the choice of applicable law does not deprive you of the protection guaranteed by the mandatory provisions of the country of your habitual residence.

Part II. Privacy Policy
This Policy explains what data the Pelan service (Telegram bot @indo_pelan_bot) processes, why, who it is shared with, and what rights you have. The Policy is an integral part of the Terms (Part I).
1. Who processes your data
The data controller is the Operator of the Pelan service. Contact for data questions: pelan_bot@proton.me.
2. What data we process
2.1. Telegram account data (stored):
- Telegram ID;
- the username and/or name specified in Telegram;
- usage counters (number of Requests, remaining Credits, limits);
- payment status and details of purchased Plans (without full payment details).
2.2. The content of your Requests (processed, not stored on a permanent basis): the text you send; images/screenshots of conversations; voice messages and their transcripts. This content is processed solely to generate a reply. We do not save it in the database, in files, or in logs. So that the Bot can understand follow-ups within a single conversation, a few recent messages may be temporarily held in RAM; they are erased when the Bot restarts and when you use the /start command.
2.3. Technical data: service information needed to run and protect the Bot (for example, timestamps, failure indicators, anti-abuse signals). We aim to keep such data to a minimum.
2.4. Payment data: we can see the fact and amount of a payment, but full card details and payment secrets are processed by payment intermediaries, not by us.
3. Why we process data
We process data to:
- provide the service itself — receive Requests and generate replies;
- keep track of limits, Credits, and payments;
- ensure security and prevent abuse and fraud;
- respond to your enquiries and comply with legal requirements.
The legal bases for processing are generally: performance of the contract with you (providing the service), our legitimate interest (security, abuse prevention), and your consent where it is required. You give consent to the processing of the content of your Requests separately and knowingly — by the very act of sending that content to the Bot; you may withhold such consent by not sending the corresponding data, and you may withdraw it for the future by ceasing to send it.
4. Sharing data with third-party AI providers
For the Bot to work, the content of your Requests is shared with third-party providers of artificial-intelligence technologies, in the following processing categories:
- a text and image analysis provider — generating the reply to your Request (currently Anthropic, Claude models);
- a speech transcription provider — converting voice messages into text (currently fal.ai, the Whisper model).
The list of specific providers may be updated; its current composition is available on request via the contact in Section 11.
4.1. These providers process the transferred data on their own servers in accordance with their own terms and privacy policies. Servers and processing may be located outside your country.
4.2. Cross-border transfers and your consent. Because processing takes place outside your country, a cross-border data transfer occurs. The legal mechanisms for such transfers (recognition of an adequate level of protection, contractual safeguards with providers, and/or your explicit consent) apply in accordance with mandatory provisions of the law applicable to you. By sending the content of a Request to the Bot, you give your explicit consent to its cross-border transfer to the providers listed above for processing; you may withhold that consent — simply do not send data you do not want processed.
4.3. We choose providers that state they do not use data submitted via their application programming interface (API) to train their models.
4.4. In addition to AI providers, data is processed by the Telegram infrastructure (message delivery) and by payment intermediaries (payment processing) — independent third parties with their own rules.
4.5. We share with third parties only what is necessary for the relevant feature to work, and we do not sell your data.
5. How long we keep data
- The content of Requests (text, images, voice, transcripts) is not saved in the database, files, or logs; a few recent messages may be temporarily held in RAM within the current conversation and are erased when the Bot restarts and when you use the
/startcommand. - Account data, counters, payment status are kept while you use the Bot and for a necessary period after you stop using it, as well as for the periods required by law (for example, for payment accounting).
- Data held by providers (see Section 4 — AI providers, Telegram, payment systems) is stored under their own policies, which we do not control.
6. Security
We take reasonable technical and organizational measures to protect data (access restrictions, secure transfer channels). That said, no service can guarantee absolute security; by transmitting data over the internet, you accept the corresponding residual risk.
7. Warning: do not send other people’s data without a lawful basis
7.1. When you send the Bot screenshots of conversations, voice, or text, you may be transferring personal data of third parties (names, contact details, the content of private conversations, and more).
7.2. Please do not send other people’s personal data — and especially sensitive data (about health, documents, finances, and the like) — without a lawful basis, for example, without those people’s consent.
7.3. By sending such data, you confirm that you have a lawful basis to do so and accept responsibility for transferring it. Where possible, remove or mask unnecessary third-party data before sending.
7.4. Our commitments. For our part, we minimize processing, do not store the content of Requests on a permanent basis (see clauses 2.2 and 5), share it only with the providers needed to generate a reply (see Section 4), and apply reasonable security measures (see Section 6).
8. Your rights
Depending on the law applicable to you, you may have the right to: obtain information about your data and a copy of it; request correction or deletion; restrict or object to processing; withdraw consent (without affecting processing carried out before withdrawal); and lodge a complaint with a supervisory authority.
To exercise your rights, write to pelan_bot@proton.me. To protect your data, we may ask you to confirm that the request comes from the account owner (for example, from the same Telegram account).
9. Children
The Bot is not intended for anyone under 18. We do not knowingly collect children’s data. If you believe a child’s data has been shared with us without a lawful basis, please let us know at pelan_bot@proton.me.
10. Changes to this Policy
We may update this Policy. A new version takes effect upon publication (via the /terms command and via the link on the service’s page). We give notice of material changes, and they may require your renewed consent. By continuing to use the Bot after non-material changes take effect, you accept the updated Policy.
